Santa Clara bicycle accident case continues.
The defense rested its case on Thursday in the trial of Sandra Arlia, the woman accused in the bicycle accident death of Rory Tomasello.
Tomasello, aged 22, died Nov. 2, 2009 after suffering a head injury related to the accident. According to police reports and eyewitness testimony, Tomasello was riding his bicycle through a crosswalk just east of the Centennial Recreation Center when he was struck by a Cadillac SRX driven by the 67-year-old Arlia.
The victim had safely crossed the two eastbound lanes of the crosswalk and came to a stop in the center median to wait for a break in westbound traffic. After a Toyota Prius stopped on the inside lane, Tomasello attempted to cross the street. He was then struck by Arlia's SUV, which was traveling westbound in the outside lane. His body was launched off his bicycle and into the street, landing approximately 30 feet away from where he was struck. The victim was not wearing a helmet at the time.
When paramedics reached the scene of the bicycle accident, Tomasello was awake but disoriented. He was taken to the trauma center at San Jose Regional Hospital, where he later died of blunt force-related head injuries. The defense has argued that Arlia did not act negligently in causing the accident while the prosecution believes she should be held responsible for the bicyclist's death. If convicted, Arlia could face up to one year of jail time.
